SIP-EIT Scheme- Stride towards Financial Support for MSMEs

Propelled by the Department of Electronics and Information Technology (DeiTY), SIP-EIT Scheme is the scheme introduced to grant financial support to the Technology Startup units and MSMEs for international patent filing.

In addition to this, to boost up innovation and acknowledge the capabilities and value of global IP along with seizing growth opportunities in the ICTE sector. Moreover, to intensify and create IP awareness, the additional component has also been introduced in the second phase of the SIP-EIT Scheme.

The two Schemes under the SIP-EIT Scheme

As we learned in the introduction that the SIP EIT scheme comprises of two schemes, we will now learn about them.

Intending to motivate the filing of International Patents, SIP-EIT Scheme has been brought into existence. Additionally, this scheme also supports the International Patent Protection in Electronics & IT by the Technology Start-Up Companies as well as the Small and Medium Enterprises.

Aid for the International Patent Protection in Electronics & Information Technology

  • Under the SIP-EIT Scheme, the Department of Electronics and Information Technology (DeiTY) has also announced to grant a reimbursement which will be limited to a total of ₹15 lakhs.
  • In addition to this, this reimbursement that will be provided will be up to a maximum of 50 % of the expenses incurred in filing patent.

The SIP-EIT Scheme

  • The SIP-EIT Scheme is a startup that has been introduced with the purpose of generating employment and wealth creation.
  • Except for this, the SIP-EIT Scheme also aims to develop as well as innovate the services and products in India to increase its employment rate.
  • In addition to this, since the inception of the SIP-EIT Scheme, the DeiTY has launched several programs to provide support to the entrepreneurs as well as generate employment opportunities for the people of the country.
  • Moreover, under the SIP-EIT Scheme the government has also initiated several schemes to provide support for International Patent Protection in Electronics & Information Technology (SIP-EIT).

Key Features of SIP-EIT Scheme

Listed below are some salient features of the SIP-EIT Scheme:-

  • This scheme revolves around providing financial support for international filing in Information Communication Technologies and Electronics sector.
  • In addition to this, the applicants can apply for availing the financial assistance at any level of the international patent filing.
  • But the reimbursement that is granted under this scheme will only be pertinent to the expenditures incurred from the date of acceptance by the DeitY subject.
  • Along with this, concerning the ownership of the patent, the application filed in the name of the owner can also be considered.
  • Moreover, the authorities can also ask the applicant to assign the ownership to the company only after the DeitY grants its approval over it to grant support under this Scheme.
  • Additionally, to apply under this Scheme, the applicant should either be a member of the Board of Directors or should be an existing employee.
  • Furthermore, the applications that will be considered under the SIP-EIT Yojana will only be considered.

Benefits

The SIP-EIT Scheme has some additional benefits attached to it which are as follows:-

  • This scheme provides financial support for international filing in information Communication Technologies and Electronics sector.
  • Additionally, the support schemes can be applied at any stage of international patent filing by the applicant.
  • Moreover, additional financial support is provided for international patent filing in the ICTE sector to eligible entities.
  • In addition to this, the expenses incurred refer to official fees incurred for expenses on search, examination, processing fees, attorney charges, cost of translation, and filing.
  • Apart from this, the expenditures will only be reimbursed if they are incurred from the date of acceptance of the application.
  • Furthermore, the SIP-EIT Yojana will also help the applicants in entering the global market.
  • Except for this, the scheme also plans to conduct IPR awareness programmes to help the MSMEs in understanding the concept.

Eligibility Criteria of the SIP-EIT Scheme

Intending to avail of the benefits offered under the Support for International Patent Protection in Electronics & Information Technology (SIP-EIT Scheme), the applicants are required to meet the following eligibility criteria:-

1- The applicant should be registered as an MSME unit and the proof of such registration must be furnished.

2- Additionally, the applicant must fulfil the requirement of investments in the equipment as per the MSME Act, 2006 of GOI as applicable or in the machinery equipment.

3- Furthermore, same will be verified based on the MSME registration proof and the audited sheet.

4- In addition to this, to register a business enterprise or a startup in the incubation center, the applicant is required to meet all the requirements of the investment that is needed in the MSME Act, 2006 of GOI as applicable.

Criteria for Applications

  • According to the Indian Patent Act, application where the applicant has already filed a patent application in India will be considered eligible.
  • Additionally, the innovation should be related to the Information or Communication or Technology or Electronics.
  • Moreover, there should be legal proofs of approvals for the reputed institutions.
  • Along with this, for the foreign filling in all countries, only one application will be considered for specific inventions.

Requisite Documents for SIP-EIT Scheme

To apply for the SIP-EIT Scheme, the applicants are required to provide the documents mentioned in the table given below.

Types of Units

The Important Documents

For a Technology Incubation Enterprise

  • A copy of Registration Certificate provided by a competent authority.
  • The copy of the audited balance sheet.

If applied for Direct International Filing

  • One copy of proof of the filing. 
  • Copy of technical write-up of the invention. 
  • The patent search report. 
  • The copy of E-payments transfers details. 
  • The copy of declaration form sealed by the concerned.

In case of MSME unit under the MSME Development Act 2006

  • One scanned copy of the Registration Certificate.

Auditor’s statement

  • Documents related to the investment in the machinery and equipment.

If the Applicant is an employee or Member of the Board of Directors

  • Copy of the latest Annual Report.
  • Copy of Official Filing Receipt.

The Financial Assistance

Under the SIP-EIT Scheme, the reimbursement of all the expenses will be in instalments and will be disbursed in the ways mentioned below: –

1- Applications filed through the PCT route

  • 25% of the charges incurred in filing the PCT application will be reimbursed and it will be subject to the International Search Report (ISR) report.
  • 25% of the charges that are included in the examination will be reimbursed only in case of a positive report.
  • 25% of the charges will be marked in filing the national phase application in any foreign country.
  • 75% of the expenses will be incurred post to National filing.

2- Applications filed within 12 months of a patent application

  • Reimbursement of 25% of the expenses incurred in the filing of the patent application.
  • 75% of the expenses incurred subsequent to the filing up and grant will also be refunded post the grant of the patent.

3- Applications that are filed directly in a foreign country post fulfilling the requirement of Section 39 of the Indian Patent Act

  • 75% of the expenses incurred to the filing up to grant will be refunded post the grant of the patent.
  • Reimbursement of 25% of the expenses that are incurred in the filing of the patent application.

Intending to register under the SIP-EIT Scheme, the applicant must fulfill the eligibility criteria.

Additionally, the applicants who wish to avail of the benefits offered under the scheme must create a login which will be used for all type of communication in the future.
